Terms of Service

These Terms of Service ("Terms") govern your use of Athletiks.io (the "Service") provided by Athletiks ("we," "our," or "us"). By accessing or using the Service, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. User Eligibility

You must be at least 14 years old to use the Service. By using the Service, you represent and warrant that you meet the age requirement and have the legal capacity to enter into these Terms.

2. Use of the Service

2.1. Registration

To access certain features of the Service, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

2.2. User Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree not to share your account credentials with others and to immediately notify us of any unauthorized use of your account.

2.3. Prohibited Conduct

You agree not to:

  • Use the Service for any illegal, unauthorized, or prohibited purpose.
  • Interfere with or disrupt the Service or the servers and networks connected to the Service.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Transmit viruses, worms, or other malicious code.
  • Violate any applicable laws, regulations, or third-party rights.

3. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, images, and software, are the property of Athletiks or its licensors and are protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Service without our prior written consent.

4. Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

5. Termination

We reserve the right to suspend or terminate your access to the Service at our sole discretion, with or without cause, and without notice. Upon termination, your right to use the Service will immediately cease, and you must cease all use of the Service.

6. Disclaimer of Warranties

The Service is provided "as is" and "as available" without any warranties of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

7. Limitation of Liability

In no event shall Athletiks be liable for any direct, indirect, incidental, special, or consequential damages, or damages for loss of profits, revenue, data, or use, incurred by you or any third party, whether in an action in contract or tort, arising from your access to or use of the Service.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law principles.

9. Changes to the Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the revised Terms on the Service with an updated effective date. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.

10. Payments, Tickets, and Refunds

10.1. Ticket Purchases

Athletiks acts as a technology platform that enables event organizers to sell tickets to participants. Unless explicitly stated otherwise, all ticket purchases made through the Service are final.

10.2. No Right of Withdrawal for Events

In accordance with Article 103(l) of the Spanish General Law for the Defense of Consumers and Users (Real Decreto Legislativo 1/2007), the statutory 14-day right of withdrawal does not apply to the purchase of tickets for leisure activities or events that take place on a specific date or during a specific period.

10.3. Refund Policy

Tickets purchased through the Service are non-refundable, except where:

  • the event is cancelled by the organizer, or
  • a refund is required by applicable law, or
  • the organizer explicitly allows refunds under specific conditions clearly stated on the event page.

Once a ticket has been used (including, but not limited to, QR code scan or event check-in), no refund is possible under any circumstances.

10.4. Organizer Responsibility

Refunds, if applicable, are managed according to the event organizer’s policy. Athletiks is not responsible for refund decisions made by organizers, except where required by law.
